Terms of Service

These Terms of Service ("Terms") govern your use of the services provided by Titan Pulse, LLC, an Illinois limited liability company ("Titan Pulse," "we," "us," or "our"). By accessing or using our website at titanpulse.io (the "Website") or any of our AI marketing services, you agree to these Terms.
If you do not agree, do not use our services.

2. Definitions
For purposes of these Terms:
- "Services" means all AI-driven voice agents, chatbots, marketing automation tools, digital marketing services, software, consulting, and related support provided by Titan Pulse.
- "Client," "you," or "your" means the individual or business using Titan Pulse services.
- "AI Systems" means machine learning models, voice agents, chatbots, algorithms, training workflows, and underlying software used to deliver the Services.
- "Training Data" means text, audio, customer information, business details, scripts, and other content provided by Client for customizing the AI Systems.
- "Third-Party Integrations" means tools, software, or platforms not owned by Titan Pulse but integrated with the Services (e.g., GoHighLevel, CRMs, phone systems).
- "Subscription Fees" means recurring monthly payments for continued access to the Services.
3. Scope of Services
Titan Pulse provides AI-powered automation and marketing tools, including but not limited to: AI voice agents for inbound or outbound communication, AI chatbots for websites and messaging platforms, automated marketing workflows, consulting and implementation services, and integrations with third-party systems such as GoHighLevel. Services may evolve over time. Titan Pulse reserves the right to add, modify, or discontinue features.
4. AI-Specific Service Limitations
While our AI Systems are designed to be accurate and reliable, the following limitations apply:
- AI outputs may contain inaccuracies, errors, or unintended responses.
- AI Systems require adequate training data for optimal performance.
- AI Systems may not be suitable for regulated industries without proper Client oversight.
- Titan Pulse cannot guarantee human-level accuracy, compliance, or judgment.
- You are responsible for reviewing AI outputs and ensuring they meet your business needs.
5. Client Responsibilities
You agree to:
- Provide accurate and lawful Training Data for use in AI Systems.
- Obtain all necessary permissions and rights to share customer data or business data with Titan Pulse.
- Not use AI Systems for unlawful, harmful, unethical, or deceptive activities.
- Review outputs and monitor content generated by AI Systems.
- Maintain compliance with all applicable laws, including marketing and communication regulations.
You retain ownership of all Training Data you provide.
6. Payment Terms
6.1 Subscription Fees
Services are billed on a monthly recurring basis. Fees are due upfront and automatically billed unless canceled.
6.2 Setup Fees
Some Services require a one-time setup fee, due before onboarding begins.
6.3 Late or Failed Payments
If a payment fails or is overdue, we may suspend or terminate services.
7. Refund Policy
- Setup fees are non-refundable.
- Monthly subscription fees are non-refundable once the billing period begins.
- Refunds are only issued if required by applicable law.
8. Intellectual Property
8.1 Titan Pulse IP
Titan Pulse owns all rights to AI Systems, algorithms, models, software, scripts, and tools, as well as branding, trademarks, and Website content. Nothing in these Terms transfers ownership to the Client.
8.2 Client IP
You own your Training Data and all content provided to us. You grant Titan Pulse a non-exclusive, royalty-free license to use Training Data solely for delivering the Services.
8.3 Improvements to AI Systems
Titan Pulse may use anonymized, aggregated data to improve its AI Systems. Client data will not be publicly disclosed.
9. Data Privacy & Security
- Titan Pulse takes commercially reasonable measures to secure systems and data.
- However, no system is 100% secure, and we cannot guarantee protection from all cyber risks.
- Clients are responsible for ensuring the lawful use of customer data submitted to the Services.
- Titan Pulse does not sell or share Client data with third parties except as needed to deliver the Services.
A separate Privacy Policy may apply.
10. Third-Party Integrations
Our Services may connect with platforms such as GoHighLevel, CRMs, phone systems, analytics tools, and messaging platforms. You agree that use of third-party tools is governed by their own terms, Titan Pulse is not responsible for outages, changes, or limitations imposed by third-party platforms, and some service functionality may depend on the performance of third-party providers.
11. Service Levels & Uptime
Titan Pulse aims to maintain high availability; however, no guaranteed uptime is offered unless a separate SLA is signed, scheduled or emergency maintenance may cause temporary downtime, and AI features dependent on third-party APIs may experience interruptions.
12. Restaurant Industry Compliance & Additional Regulations
Titan Pulse provides AI services tailored for restaurants, including customer inquiries, reservations, ordering assistance, marketing campaigns, and loyalty engagement. Because restaurants are subject to unique operational, data, and communication standards, the following additional provisions apply:
12.1 Food & Restaurant Industry Disclaimers
Titan Pulse's AI Systems may assist with tasks such as providing menu information, answering customer questions, or guiding customers through reservations or orders. However: AI Systems must not provide medical, allergen, or dietary safety advice beyond what you explicitly supply. Clients must ensure all menu, allergen, ingredient, and nutritional information given to Titan Pulse is accurate and up to date. Titan Pulse is not responsible for harm resulting from inaccurate or outdated menu or allergen data provided by the Client.
12.2 Reservation, Ordering, and Customer Interaction Compliance
Clients are responsible for ensuring all AI-assisted communications comply with local and state restaurant communication rules, order accuracy standards, reservation and waitlist management regulations, and customer complaint-handling requirements mandated by local authorities.
12.3 Payment and PCI Compliance (If Integrated)
If Clients use AI Systems that touch any part of a payment workflow: Titan Pulse does not process or store credit card details. Any payment-related actions must use PCI-compliant third-party systems. Client is responsible for ensuring its connected POS or ordering systems meet PCI DSS requirements.
12.4 Health, Safety, and Operational Regulations
Restaurant operations are governed by health and safety rules, including local health department regulations, the FDA Food Code (where applicable), and state restaurant licensing laws. Titan Pulse does not provide legal compliance advice. The Client must ensure all AI-generated communication adheres to local restaurant operating standards.
12.5 Compliance with Communication Regulations
Clients are responsible for ensuring compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, local, state, and federal telemarketing laws, SMS/MMS regulations, and recording consent laws (if applicable). AI agents must not be used for unlawful or non-compliant communications. Titan Pulse is not liable for Client misuse.
13. Limitation of Liability
To the fullest extent permitted by law:
- Titan Pulse is not liable for indirect, incidental, special, or consequential damages.
- Our total liability for any claim is limited to the amount paid by the Client in the previous 90 days.
- Titan Pulse is not responsible for: AI-generated errors, loss of data, third-party service failures, or Client misuse of AI Systems.
Some jurisdictions may not allow certain limitations, so they may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless Titan Pulse from any claims, damages, or losses arising out of your use or misuse of the Services, violation of these Terms, violation of communication or marketing laws, or use of Training Data or content provided by you.
15. Termination
15.1 By Client
Clients may terminate anytime by providing written notice and canceling billing. No refunds for unused time.
15.2 By Titan Pulse
We may terminate or suspend Services if payments are overdue, the Client violates these Terms, or the Client engages in unlawful or abusive behavior.
15.3 Effect of Termination
- Access to Services will end immediately.
- Client must download any necessary data before termination.
- Titan Pulse has no obligation to store data after termination.
16. Dispute Resolution & Arbitration
Any dispute related to these Terms will be resolved through binding arbitration administered in Illinois.
16.1 No Class Actions
Disputes must be brought individually.
16.2 Exceptions
Either party may seek temporary or preliminary injunctive relief, or claims within small claims court jurisdiction.
17. Changes to Terms
Titan Pulse may update these Terms at any time. Continued use of the Services after changes means you accept the new Terms.
